1. About CreateSafe

Createsafe ("we," "our," or "us") is operated by or affiliated with a law firm licensed to practice in the State of Georgia. We provide legal services that include trademark filings, copyright filings, contract review, and contract revisions, along with other related legal matters.

 

By using our website, platform, or services (collectively, the "Services"), you agree to these Terms of Service ("Terms"). 

2. General Disclaimers

2.1 No Attorney-Client Relationship from Website Use

Accessing, browsing, or communicating through this website does not automatically create an attorney-client relationship between you and our firm. An attorney-client relationship is established only when:

1. You have entered into a written engagement agreement with our firm, and

2. We have explicitly agreed in writing to represent you in a specific legal matter, and

3. We have conducted a conflicts check and confirmed we can represent you

For trademark and copyright services, we can assist clients nationwide. For transactional matters such as contract review and revision, we can work with clients in multiple jurisdictions, though the specific governing law of your contract or transaction may vary based on your business needs and circumstances.

4. Eligibility

You must be at least 18 years old and legally able to enter into binding contracts to use our Services. By using Createsafe, you confirm that all information you provide is accurate and complete.

5. Refund Policy

5.1 Non-Refundable Fees

Once a consultation has taken place and legal services have been initiated, attorney fees are earned for services performed and are non-refundable.

 

This includes:

• Initial consultations (if a consultation fee was charged)

• Legal research and analysis completed

• Document review and preparation (including trademark applications, copyright registrations, and contract reviews)

• Filing submissions to government agencies

• Correspondence and communications on your behalf

• Any other legal work performed prior to termination of representation

5.2 Termination of Representation

Either party may terminate the attorney-client relationship subject to Georgia Rules of Professional Conduct. Upon termination:

• You will receive a final billing statement itemizing all services performed

• You remain responsible for payment of all earned fees and costs incurred

• You will receive a refund of any unearned fees held in trust

• We will provide you with your file and any documents necessary to protect your interests

 

5.3 Third-Party Costs and Filing Fees

Government filing fees (such as USPTO trademark fees or U.S. Copyright Office fees), service fees, and other third-party costs paid on your behalf are separate from attorney fees and are nonrefundable once paid to the third party.

 

5.4 Disputed Fees

If you have a dispute regarding fees, you have the right to:

1. Request a detailed explanation of all charges

2. Seek fee arbitration through the State Bar of Georgia

3. File a complaint with the State Bar if you believe our conduct violated ethical rules

6. Confidentiality

All information you share with us in the course of representation is protected by attorney-client privilege and Georgia law. We will not disclose your confidential information except as required by law or with your consent.

7. No Guarantee of Outcome

While we aim to provide high-quality legal services, we cannot guarantee a particular result or outcome in any matter. Legal outcomes depend on many factors beyond our control, including decisions by government agencies, third parties, and courts.

8. Intellectual Property

All content, materials, and tools on the Createsafe website are owned or licensed by Createsafe or its affiliates. You may use them only for your personal or business use related to our Services. You may not copy, reproduce, or distribute any materials without permission.

9. Limitation of Liability

To the fullest extent allowed by law, Createsafe and its affiliated law firm are not liable for any indirect, incidental, or consequential damages arising from your use of the Services. Our total liability for any claim shall not exceed the total amount paid by you for the Services giving rise to the claim.

10. Dispute Resolution (Mediation First)

If a dispute arises out of or relates to these Terms or our Services, both parties agree to first attempt to resolve the issue through good-faith mediation in Fulton County, Georgia. Either party may request mediation by giving written notice to the other. Mediation will be conducted by a neutral third-party mediator agreed upon by both sides. Each party will bear its own costs and share the mediator's fees equally. If the dispute is not resolved through mediation, either party may then bring a legal action in the appropriate state or federal court located in Fulton County, Georgia, as described below.

11. Governing Law and Jurisdiction

These Terms and any dispute arising from them are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Fulton County, Georgia, and both parties consent to the jurisdiction and venue of those courts.

12. Changes to These Terms

We may update these Terms from time to time. The latest version will always be available on our website, with the effective date listed at the top. Continued use of the Services means you accept the updated Terms.
